  1. ISRAEL PATENT OFFICE GOES GREEN-“ENVIRONMENTAL PATENT APPLICATION PROSECUTION HIGHWAY”

A New Registrar’s Circular (Registrar’s Circular M.N. 76) was issued this week, which will come into force on December 27, 2009. The Registrar is to provide quicker examination for patent applications, whose product/method provides a beneficial environmental effect. This is not considered to be expedited examination and requires no extra fee.

Moreover, these patent applications will be classified into a new classification code. In order for applicants to have their patent applications classified as such, they will have to provide, together with their application, a short explanation of their invention and how it benefits the environment.

Patent applications already filed will also be considered for reclassification, provided that the applicant furnishes a request with a short explanation of their invention and how it benefits the environment.

These “green” patent applications will be examined within three months of qualifying for the “green classification code”.

  1. COMPUTER RELATED INVENTIONS IN ISRAEL

The Israel Patent Office is interested to updated its methodology of examination of Computer-related inventions and has asked the general public to provide policy papers in this regard. Our office is preparing a policy paper.
The policy paper must be submitted by February 15th, 2010. We would welcome any comments or inputs from you. See also:-

  1. NEW MASSIVE EXCESS CLAIMS FEES

Notification of December 10, 2009
A new patent regulation is to be enforced from January 01 2010, in which any claim from the 51st claim onwards will incur an excess claim fee of 500 NIS per additional claim..

Any new patent application filed in Israel should therefore be accompanied with a cover letter, which states the number of claims and provides a statement of payment of the sum for the excess claims, together with the receipt of payment therefore.

Moral of the story- be nice to the Examiners and limit the number of claims to 50 or under!

  1. ISRAEL PATENT AUTHORITY IS TO BECOME A WIPO PATENT SEARCHING AUTHORITY

The Israel Patent Office, now officially, the Israel Patents Authority, has trained a large number of new Examiners over the last couple of years, moved location to a suitable building and has now become a formal International Searching Authority. On September 29, 2009, in the annual meeting of WIPO (World Intellectual Property Organization), it was announced that the Israel Patents Authority became a registered WIPO patent searching authority, alongside a few of the best patent offices in the world, such as the US Patent and Trademark Office, the European Patent Office and the Japanese Patent Office.   For current list of ISAs See http://www.wipo.int/pct/guide/en/index.html
